What is the Unruh Act?

Enacted in 1959, the Unruh Civil Rights Act, named after its author, Jesse Unruh, is a California law that prohibits discrimination based on protected characteristics, such as race, gender, religion, disability, and sexual orientation. It covers various scenarios, from discrimination by businesses and housing providers to workplace discrimination. The Unruh Act aims to create a level playing field, ensuring fair and equal treatment for all individuals, regardless of their background or identity.

Unruh Act claims: common scenarios

The Unruh Act is a powerful tool for combatting discrimination, and it applies to various situations where individuals may face unfair treatment. One common scenario involves discrimination in public accommodations, such as restaurants, hotels, and stores. If you've experienced refusal of service or unequal treatment based on a protected characteristic in these settings, the Unruh Act may come into play. 

Another common scenario for an Unruh claim involves websites not accommodating users with disabilities. This results from contemporary interpretations of the Americans with Disabilities Act (ADA), which assert that a business’s website qualifies as a place of public accommodation. Under this interpretation, the accessibility of websites also falls under Unruh's purview. 

The consequential Robles v. Domino's Pizza case exemplifies needing to be more inclusive and accommodating. In this case, a blind Californian sued the famous pizza chain due to its website’s incompatibility with screen readers. As the case was filed in California, Domino's faced accusations of violating the ADA and Unruh Act.

Statute of limitations 

In legal terms, the statute of limitations is a defined timeframe within which a person must file a lawsuit or claim after a particular event. 

It protects both the plaintiff and the defendant, ensuring that claims are brought forth within a reasonable period and preventing the potential for endless litigation.

Statute of limitations for Unruh Act claims

According to the California Civil Rights Department (CRD), Unruh claims have two different timeframes, depending on the nature of the complaint or lawsuit.

If a plaintiff wishes to file an Unruh claim through the CRD, they must do within one year from the date of the alleged discriminatory act. You have one year to take legal action and file your claim with the appropriate court.

However, plaintiffs don’t have to file an Unruh claim through the CRD. This results in the suit remaining private. In the case of private Unruh claims, plaintiffs must file within two years of the discriminatory act.

Consequences of missing the deadline

Missing the deadline to file a claim under the Unruh Act can have significant consequences. Primarily, plaintiffs risk losing their right to pursue legal action and seek remedies for the discrimination they may have experienced. 

Should a plaintiff attempt to file a claim after the statute of limitations has expired, the defendant can raise the expired statute of limitations as a defense. In light of this, they can reasonably argue for dismissing a claim if it was not filed within the required timeframe. It is not wise for a plaintiff to gamble whether or not the court will side with them on this matter. No matter how egregious the alleged discrimination, the court may still dismiss an Unruh claim on the grounds of belated filing.

It's important to understand that the statute of limitations is essential in the legal system. Over time, evidence can whither, memories of an incident can distort with time, and witnesses can become elusive. These time limits ensure that claims are filed while the evidence remains fresh and readily available. This protects defendants' rights and encourages plaintiffs to take timely action and seek resolution for their grievances.
